Terms and conditions
1) Definitions
1.1 The term “Online Sales Contract” means the sales contract relating to movable tangible assets marketed by Camiceria Mazzarelli, stipulated between the latter and the consumer, in the context of a remote sales system via online tools, hosted by Camiceria Mazzarelli.
1.2 The term “Customer” means the consumer as in a natural person making the purchase referred to in this contract and is not related to any commercial or professional activity carried out by the Customer.
2) Object of the Contract
2.1 With this contract, respectively, Camiceria Mazzarelli sells and the Customer remotely purchases, via online tools, the tangible movable assets indicated and offered for sale on the website www.camiceriamazzarelli.com.
2.2 The products referred to on the previous point are illustrated on the website www.camiceriamazzarelli.com and described in accordingly on individual information sheets; the image accompanying a product may not be fully representative of its characteristics, and may differ in color, size and accessories.
2.3 These general conditions of sale do not regulate the supply of services or the sale of products made by third parties who use direct links to the site www.camiceriamazzarelli.com through banners or through other hypertext links / links. Under no circumstances can Camiceria Mazzarelli be held responsible for the provision of services promised by third parties or for the execution of e-commerce transactions between Camiceria Mazzarelli customers and third parties.
2.4 Camiceria Mazzarelli reserves the right not to process orders received from users who are not “Customers”, as well as any other order that does not adhere to the commercial policy of Camiceria Mazzarelli.
3) Stipulation and Termination of Contract
3.1 The contract between Camiceria Mazzarelli and the Customer is stipulated through the Internet by the Customer accessing www.camiceriamazzarelli.com, where, following the procedures indicated, the Customer will formalize the request for the purchase of goods referred to in points 2.1 and 2.2 of the previous article.
3.2 The purchase contract is finalised by completing the following procedure, available only in Italian, which can always be corrected, modified and cancelled, until the time the order is submitted:
- By accessing the website www.camiceriamazzarelli.com, the Customer, after registering the purchase, must add the desired products to the cart, complete all subsequent steps by following the instructions on each page, and electronically submit the data to Camiceria Mazzarelli;
• The order page contains a link to these general conditions of sale and also contains information on the main characteristics of each product ordered and the relative pricing (including VAT), the desired payment type for the purchase, delivery conditions, the terms required for delivery and transport as well as references to the general terms and conditions for the return of products purchased online;
• Before proceeding with submitting the order, the Customer will be asked to identify and correct any possible errors that occurred while filling in the fields and to carefully read the general terms and conditions governing the sale and purchase, to print a copy of them using the print option and/or save a copy for personal use;
• An order will be deemed submitted when Camiceria Mazzarelli receives the purchase order electronically and the information relating to the order has been preliminarily verified as correct.
3.3 The order sent by the Customer will be binding for Camiceria Mazzarelli only if the entire order procedure has been completed regularly and correctly, without any error messages being highlighted by the website, and after Camiceria Mazzarelli sends to the Customer an order confirmation email. The e-mail will contain the Customer and the order details, a summary of the general and particular conditions applicable to the contract, the price of the goods purchased, the chosen means of payment, transport costs, taxes and applicable taxes, the indication of the right of withdrawal and the shipping address to which the goods will be sent. The Customer undertakes to verify the accuracy of the data contained therein and to promptly communicate any corrections to Camiceria Mazzarelli at the addresses indicated above.
3.4 By placing an order, the Customer declares to have read all the information provided during the purchase procedure, and to fully accept these general conditions of sale. By placing the order, the Customer expressly acknowledges that this implies the obligation to pay the price and other amounts due under these general conditions of sale.
The contract is not considered completed and effective between the parties by default of what is indicated in the previous point.
3.5 Camiceria Mazzarelli may not take charge and process the order if there are insufficient guarantees of payment solvency, if the orders are incomplete or incorrect, or if the products are no longer available. In the cases mentioned above, the Customer will be informed by e-mail that the contract has not been executed and that Camiceria Mazzarelli has not confirmed the purchase order specifying the reasons.
3.6 The contract stipulated between Camiceria Mazzarelli and the Customer must be considered terminated, even if only partial, of the order by Camiceria Mazzarelli. This acceptance is considered tacit, unless otherwise communicated in any way to the Customer.
3.7 Pursuant to art. 12 of Legislative Decree 70 of 2003, Camiceria Mazzarelli informs the Customer that each order sent is stored in digital or printed format at its headquarters, according to criteria of confidentiality and security. The Customer can at any time request a copy from Camiceria Mazzarelli.
4) Payment Methods
4.1 Any payment by the Customer can only be made using one of the methods indicated on the website www.camiceriamazzarelli.com. Credit cards from major international circuits and prepaid and rechargeable cards issued by banking institutions in Italy are accepted, including: PAYPAL, (Postepay, Visa, Maestro, MasterCard, American Express, Discover, Aura.)
4.2 For payments made via PayPal, the final amount will be charged only when the order is ready for shipment. If the product is unavailable following the order submission and the card payment confirmation, Camiceria Mazzarelli will take the necessary measures with the payment operator to cancel the transaction relating to the unavailable products.
4.3 All orders, before being processed, are subjected to authenticity checks directly by the relative credit card providers, to protect the Customer’s data. If, for any reason, it is not possible to debit the amount due, the sale process will be automatically cancelled and the sale will be terminated pursuant to art. 1456 of the Italian Civil Code. The Customer will be informed by e-mail communication.
4.4 All Communications relating to payment and the data communicated by the Customer will take place via specialised protected channels with all the guarantees ensured by the use of the security protocols provided by established payment circuits.
5) Prices
5.1 The sale prices published on the website www.camiceriamazzarelli.com are to be understood as inclusive of VAT and refer only to products sold online. The price applied will be the one shown at the time of the order submission and indicated in the order confirmation e-mail, without considering price increases or decreases, even for promotions, which may have occurred subsequently.
5.2 The shipping costs, charged to the Customer for orders below €45, are not included in the purchase price, but are indicated and calculated at the time of the completion of the purchase process prior to payment being made.
5.3 The issuance of the invoice is not mandatory, if it is not requested by the Customer no later than the time of carrying out the operation, as indicated in art. 22 of the D.P.R. of 26/10/1972 n. 633. By submitting the order to Camiceria Mazzarelli, the Customer agrees to receive the invoice / receipt in electronic format. The Customer may receive the invoice / receipt in paper format by making a direct request to Camiceria Mazzarelli. After the invoice has been issued, it will not be possible to make any changes to the data indicated therein.
6) Product Availability
6.1 The availability of the products refers to the instance in which the Customer consults the product data sheets; however, this must be considered purely indicative because, due to the simultaneous presence on the site of multiple users, the products could be sold to others before the order is submitted and confirmed. In any case, Camiceria Mazzarelli cannot be attributed responsibility in the event of unavailability of one or more products.
6.2 Camiceria Mazzarelli will not be responsible in any way for the temporary or permanent unavailability of one or more products. The website highlights the cases in which limitations on the purchase of individual products apply. In case of unavailability, even temporary, of the requested products, Camiceria Mazzarelli undertakes not to charge the Customer the corresponding price. If the order has been sent and the price has already been paid for the items that are no longer available, Camiceria Mazzarelli will refund the Customer for the full amount paid for those items.
6.3 Even after the order confirmation e-mail is sent by Camiceria Mazzarelli, there may be instances of partial or total unavailability of the ordered products. In this case, the Customer will be promptly informed by post or by e-mail and can opt to accept the delivery of only the products available (obtaining a full refund for unavailable products), or request the cancellation of the order with full refund of any paid amounts by communicating it via e-mail to Camiceria Mazzarelli.
6.4 For the eventuality referred to in the previous point, the Customer can choose, at the time of submitting the order, whether to accept a product other than the one requested, of the same value.
7) Delivery Methods
7.1 Camiceria Mazzarelli will deliver the products selected and purchased by express courier to the address indicated by the Customer at the time of the order, as confirmed in the summary e-mail referred to in point 3.3.
7.2 Orders will be processed as soon as they are received. Camiceria Mazzarelli undertakes to deliver the products in the shortest possible time and in any case within 30 days from the date of submission of the contract.
7.3 The total amount of expenses will be visible before proceeding with the confirmation of the order.
7.4 The shipped products will be checked and delivered to the shipping forwarder intact and without defects. Camiceria Mazzarelli cannot be held responsible in any way for any delays or damage attributable to the fault of the shipper.
7.5 The ordered products depend solely on the acceptance of the Customer. Should the shipment be refused, Camiceria Mazzarelli will charge the Customer for the return shipping costs.
8) Liability
8.1 Camiceria Mazzarelli assumes no responsibility for lack of services due to force majeure or unforeseeable circumstances, even if due to malfunctions and lack Internet service, in the event that these disservices result in failure to execute the order within the time stipulated in the contract.
8.2 Camiceria Mazzarelli will also not be liable for damages, losses and costs suffered by the Customer as a result of the non-execution of the contract for reasons not attributable to the same, unless they are dependable on the fact or omission of Camiceria Mazzarelli. As a result, the Customer will only be entitled to a full refund of the price paid and any additional charges incurred.
8.3 Camiceria Mazzarelli cannot be held responsible for the information, data and any technical or other inaccuracies that may be contained on the site, if they have been communicated by third parties and have been verified by Camiceria Mazzarelli according to the criteria of standard diligence.
8.4 Camiceria Mazzarelli assumes no responsibility for any fraudulent or illegal use that may be made by third parties of credit cards, checks and other means of payment, upon payment of the purchased products, if it proves to have adopted all the possible precautions based on the current best practices and following standard due diligence.
8.5 The Customer undertakes to pay the price of the purchased goods within the timings and methods indicated in these General Conditions of Sale.
8.6 The Customer undertakes, once the online purchase procedure has been completed, to print and keep these Terms and Conditions of Sale, which will have already been expressly accepted before the conclusion of the procedure.
8.7 The Customer is solely responsible for the accuracy of the data entered in the registration fomrs and undertakes not to enter false, and / or fictional data. The Customer relieves Camiceria Mazzarelli from any liability arising from the issue of incorrect tax documents due to inaccurate data provided by the Customer.
8.8 Our kind customers are reminded that our items are handmade on request whenever we receive the order.
Therefore for orders over a shirt we will only deliver one that will act as a tester.
Possibilities:
In case of positive feedback (the shirt meets the expectations of customer in terms of fit, collar, fabric exc…) we will proceed with the realization and shipping of the whole order placed by the customer;
In case of negative feedback, the customer is required to proceed with the return procedures for the refund of the amount spent and the return of the shirt-test. The shipping costs are charged to the customer.
In both cases, the customer is obliged to communicate his/her response to the e-mail address info@camiceriamazzarelli.it
9) Right of Withdrawal
9.1 The Customer has the right to withdraw without any penalty but specifying the reason through the form above, within fourteen days from the day on which the Customer or third party, other than the shipper designated by the Customer, acquires physical possession of the products. In the case of a contract relating to multiple products ordered by the Customer in a single order and delivered separately, the term starts from the day on which the Customer or a third party, other than the shipper designated by the Customer, acquires physical possession of the last product.
9.2 To exercise the right of withdrawal, the Customer is required to inform Camiceria Mazzarelli, Via Enrico Fermi n. 52, Castellana Grotte (BA) 70013 of the decision to return the purchased good. To this end, the Customer can use the dedicated form included on the return request page or he can send an e-mail to this following address: info@camiceriamazzarelli.it
9.3 To meet the withdrawal deadline, it is sufficient for the Customer to send the communication relating to the exercise of the right of withdrawal before the withdrawal period has expired.
9.4 If the Customer withdraws from this contract, all payments made to Camiceria Mazzarelli will be reimbursed without undue delay and in any case no later than fourteen days from the day on which Camiceria Mazzarelli has received returned goods back. Refunds will be made using the same payment method used by the Customer for the initial transaction, unless the Customer expressly agrees otherwise.
9.5 In case of exercising the right of withdrawal, the Customer returns the goods or delivers them to Camiceria Mazzarelli at Camiceria Mazzarelli, VIA ENRICO FERMI, 52 – 70013 CASTELLANA GROTTE (BARI) ITALY, without undue delay and in any case within fourteen days from the date in to whom Camiceria Mazzarelli communicated its decision to withdraw from the contract. The shipping cost of returning the goods (also taxes and duties for extra UE countries) remains the responsibility of the Customer. Just in case of defective items the return costs of the goods are charged to Camiceria Mazzarelli.
9.6 The Customer is responsible for any drop in value of the products resulting from the handling of the goods other than that necessary to establish the nature, characteristics and functioning of the products.
9.7 If the right of withdrawal is exercised, Camiceria Mazzarelli will not be responsible for the transport costs for the return or for any loss or damage to the products attributable to third parties.
10) Privacy
The Data Controller is Camiceria Mazzarelli, with administrative headquarters in Via Enrico Fermi, 52 – 70013 Castellana Grotte (Bari) Italy, tax code and VAT number. 03783970720. To exercise the rights provided for in art. 7 of Legislative Decree 196/2003, write to Camiceria Mazzarelli for the attention of the Personal Data Processing Manager or to the e-mail address info@camiceriamazzarelli.com.
Your personal data will be used to process your order, support your experience on the official website and for other purposes described in our privacy policy.
11) Declaration
11.1 These General Conditions of Sale consist of all the clauses that make them up.
11.2 If one or more provisions of these General Conditions of Sale are considered invalid or declared as such pursuant to the law or following a decision by a body having jurisdiction, the other provisions will continue to have full force and effect.
12) Governing Law and Jurisdiction
12.1 All contractual relationships between the parties and these general terms and conditions are governed by Italian law.
12.2 For any and all dispute that may arise in relation to the application, interpretation and execution of these general conditions of sale, the responsible courts will be those of the place of residence or domicile of the Customer.
13) Final clause
13.1 This contract repeals and replaces any agreement, understanding, negotiation, written or oral, previously ensued between the parties and concerning the subject of this contract.
